By Jenna SundelShareNewsweek is a Trust Project memberAttorneys representing Taylor Swift asked Judge Aileen Cannon on Wednesday to allow them to exceed the page limit for a motion under court rules.
Attorneys representing Swift and her co-defendants in a copyright infringement case said a court rule limits motions and accompanying memorandums to 20 pages, unless the court allows the motion to exceed the page limit. The attorneys said they intend to exceed the limit by 10 pages in their motion to dismiss the case.
Why It Matters
Florida artist Kimberly Marasco is suing Swift, Universal Music Group and Republic Records for alleged copyright infringement. She alleged that Swift and her co-defendants copied her poetry in lyrics and visuals from multiple albums, including Lover, Folklore, Midnights and The Tortured Poets Department.
Newsweek reached out to Marasco and a representative for Swift for comment.
This is Marasco’s second lawsuit against Swift. Swift was dismissed from the first case in December 2024 after Marasco failed to serve the lawsuit within the time frame provided by the court. The case against Swift’s production company, Taylor Swift Productions, was dismissed with prejudice in September.
...Cannon, who rose to national prominence when she was the judge assigned to President Donald Trump's classified documents case, has presided over both lawsuits against Swift.
What To Know
The defendants in this case have until December 4 to respond to Marasco’s second amended complaint. They have been ordered by the court to file a combined response.
James Douglas Baldridge and Katherine Wright Morrone, attorneys representing Swift and her co-defendants, said in the motion that the additional 10 pages are needed to “adequately address all of the factual and legal issues raised” by the second amended complaint.
The lawyers said the motion to dismiss will thoroughly refute each instance of alleged infringement.
Baldridge and Wright Morrone said the allegations “contain frivolous and baseless allegations involving uncopyrightable metaphors and themes as well as single words and short phrases.”
The attorneys said Marasco opposes the motion to exceed the page limit.
“Defendants’ counsel conferred with Plaintiff regarding this motion in a good faith effort to resolve the issues raised herein and has not been able to do so,” Baldridge and Wright Morrone said.
What People Are Saying
James Douglas Baldridge and Katherine Wright Morrone, attorneys representing Taylor Swift, Universal Music Group and Republic Records, in a motion: “No party will be prejudiced by the grant of this motion. By contrast, Defendants would be prejudiced by the denial of this motion because it would prevent them from fulsomely responding to all of the legal and factual issues raised in the SAC.”
Kimberly Marasco, in a second amended complaint filed last month: “The substantial similarities between Plaintiff’s works and Defendants’ songs are not coincidental, but evidence unlawful copying of protectable expression.”
What Happens Next
Cannon has yet to issue a ruling on the motion to exceed the page limit.
